These Terms of Service (“Terms”) govern your use of the marketing and communication services provided by Community Communications, Inc. (“we,” “us,” or “our”). By accessing or using our website, platform, integrations, or related services (collectively, the “Services”), you agree to be bound by these Terms.

- Connect third-party accounts such as Meta (Facebook/Instagram), TikTok, Reddit, X
- Create, schedule, and manage marketing content
- Send communications such as emails, SMS/MMS messages, and social media posts
- Access analytics, logs, and reporting related to those activities
We act only as a service provider enabling communication between you and the platforms you authorize.
2. Eligibility
You must:
- Be at least 18 years old
- Use the Services on behalf of a business or organization
- Have the authority to agree to these Terms
We do not provide services for personal, non-business use.
3. Account Registration
To use the Services, you must create an account and provide accurate, current information.
You are responsible for:
- Maintaining the security of your login credentials
- Ensuring your use complies with all applicable laws
- Any activity that occurs under your account
We are not liable for unauthorized access caused by your failure to secure your account.
4. Third-Party Integrations
You may connect your accounts from third-party services (e.g., Facebook, Instagram, TikTok, Reddit, X). By doing so, you authorize us to:
- Receive the data required for authentication (OAuth tokens, scopes, expiration times)
- Publish content or send messages only as explicitly directed by you
- Refresh tokens as needed to maintain functionality
- Receive performance, delivery, and diagnostic information returned by third-party APIs
We do not store or request your passwords for any third-party service.
Your use of each third-party platform is additionally governed by their respective terms and policies.
5. User Responsibilities
You agree to:
- Use our Services only for lawful purposes
- Ensure that any content you upload or publish complies with platform rules
- Obtain consent from recipients when sending messages or emails
- Not use the Services to send spam, threats, harassment, or illegal content
- Not interfere with system performance, security, or operations
You represent that you have the rights and permissions necessary to upload and distribute any content through the Services.
6. Prohibited Activities
You may not:
- Misuse or attempt to bypass safety or rate limits
- Use the Services for fraudulent or deceptive purposes
- Attempt to access accounts or data that do not belong to you
- Reverse engineer or attempt to copy any part of the platform
- Sell or transfer access to the Services without permission
- Use the Services to violate platform rules (Meta/TikTok, etc.)
Violations may result in immediate suspension or termination.
7. Content Ownership
You retain full ownership of all content you upload, including:
- Images
- Videos
- Text
- Email templates
- SMS messages
- Campaign data
You grant us a limited, revocable license to process, store, and transmit this content solely for the purpose of providing the Services.
We do not own or redistribute your content.
8. Service Availability
We strive to maintain high uptime but do not guarantee:
- uninterrupted access
- error-free functionality
- compatibility with all devices or networks
Scheduled maintenance or external service outages (Meta/TikTok/SES/Twilio) may affect performance.
9. Fees and Payments
If applicable, you agree to pay all subscription or usage fees.
Failure to pay may result in suspension of service.
Refunds are handled per your specific plan or agreement.
10. Termination
You may stop using the Services at any time.
We may suspend or terminate access if:
- You violate these Terms
- Your connected platform accounts are removed or restricted
- Required permissions are revoked
- Payments are not completed
- We detect abuse, fraud, or system misuse
Upon termination:
- Your OAuth tokens are removed
- Posting and messaging functions cease
- Some logs may remain to fulfill legal obligations
11. Data Privacy
Your use of the Services is also governed by our Privacy Policy, which explains:
- What data we collect
- How it is used
- How it is stored
- Your rights over your data
You agree to review and comply with the Privacy Policy.
12. Limitation of Liability
To the fullest extent permitted by law, we are not liable for:
- Loss of profits, revenue, or business
- Platform outages (Meta, TikTok, Reddit, X, etc.)
- Data loss or corruption
- Unauthorized access resulting from your actions
- Errors caused by third-party APIs
Our total liability will not exceed the amount you paid for the Services in the previous 12 months.
13. Indemnification
You agree to indemnify and hold us harmless against claims arising from:
- Content you submit or send
- Misuse of the Services
- Violations of laws, regulations, or platform policies
- Disputes between you and third parties
14. Changes to the Terms
We may update these Terms at any time.
Changes take effect immediately upon posting or upon notice to you.
Continued use of the Services constitutes acceptance of updated Terms.
15. Governing Law
These Terms are governed by the laws of:
Massachesetts, United States
Any disputes will be handled in courts located in that region unless otherwise required by law.
